Terms and Conditions

1. Scope of Application
These Terms and Conditions (hereinafter referred to as “T&Cs”) govern the contractual relationship or treatment agreement between Feel-Fit AG and the patient/customer (hereinafter referred to as “the patient/customer”). These T&Cs apply in their current form at the time of the treatment between Feel-Fit AG and the patient. They exclusively govern the business relationship of the booked treatment (hereinafter referred to as “the treatment”), unless otherwise mentioned or agreed upon.

2. Data Protection
We collect, process, and store personal data in accordance with the applicable data protection regulations of Switzerland. Feel-Fit AG’s privacy policies can be accessed at www.feel-fit.ch/datenschutz. By utilizing our treatment services, the patient/customer agrees to the privacy policies.
Patient records belong to the patient/customer and can be handed over upon request at any time. They are stored by Feel-Fit AG, made available to the treating physiotherapists, and used for billing and collection purposes. For invoicing and patient and appointment management, all necessary data is shared with the software provider (Physiosys AG). Additionally, we reserve the right to share medical and patient data related to the treatment with referring and treating physicians, trust doctors of the cost bearers, and Swiss insurers of all kinds for administrative purposes, and to obtain additional patient data.

3. Cancellation Policy
Booked treatment appointments are binding, and the agreed time is reserved for the patient/customer. Missed or late-canceled appointments increase our administrative workload and cannot be charged to health or accident insurance. Therefore, the patient is requested to inform us in advance, but at least 24 hours before the appointment, if they are unable to attend.
Feel-Fit reserves the right to charge the following treatment costs privately (without reimbursement by health insurance) for late or no-show cancellations:
• Physiotherapy: CHF 60.00
• Private Physiotherapy/Massage: Corresponding booked service

4. Payment Terms
Feel-Fit AG invoices medically prescribed services under the “tiers payant” system and sends the invoice directly to the health insurance. The insurer pays the full amount and charges the patient any co-payments. All treatment costs not covered by insurance/health insurance are borne entirely by the patient, regardless of the reason for the insurer’s refusal to pay. After two unsuccessful reminders, the case will be handed over to a collection agency, with an additional charge of CHF 28.
Costs for privately invoiced treatments (private physiotherapy and massage) must be paid on-site before the next appointment or, if no further appointment is planned, within 30 days from the invoice date.
On-site payment can be made in cash or via TWINT.

5. Reclaims
It may occur that an insurance/health insurance reclaims the treatment costs already paid to Feel-Fit AG from the patient (tiers payant). By agreeing to these T&Cs, the patient confirms:

  • That the patient will handle all reclaims from insurance concerning invoices from Feel-Fit AG.
  • That Feel-Fit AG is not permitted to comply with insurance reclaim requests.
  • That Feel-Fit AG will forward reclaim requests directly to the patient/customer without taking any action.
  • That the patient/customer absolves Feel-Fit AG from having to refund amounts already received, even if Feel-Fit AG is legally obliged to refund invoices.
  • That the patient/customer is directly responsible for processing the reclaim and all associated activities such as clarification, processing, and payment.

These agreements apply to payments from basic insurance, supplementary insurance, or privately invoiced treatments that were mistakenly billed to the health insurance. Even in the case of reclaims, all treatment costs reclaimed by insurance/health insurance are fully borne by the patient/customer, regardless of the reason for the reclaim.

6. Insurance Payment Denial
Insurances/health insurance may refuse to pay treatment costs. The patient/customer commits to taking all possible measures to protect against payment denials or reclaims. The following measures are helpful:

  • If unsure whether the therapy or medical training therapy will be covered, the patient/customer should obtain a cost approval from the insurer via the doctor.
  • The patient/customer should check all invoices and inform Feel-Fit of any discrepancies.

7. Treatment
The treatment of the patient/customer follows the generally recognized and known standards and rules of modern physiotherapy and medical massage. As is generally the nature of therapeutic and medical treatment, a specific treatment success cannot be guaranteed.

8. Fitness Subscription
The patient/customer determines the amount by choosing the initial term. The agreement is initially concluded for the marked duration at the request of the user. The entire amount is due upon conclusion of the contract. The agreement can be extended by mutual consent for documented illness from 3 weeks upon presentation of a medical certificate. This also applies in case of pregnancy, military/civil service, and comparable reasons for inability to attend for a predetermined period. Suspension periods are not considered in the agreed contract term. The regular termination option and the agreed notice period are postponed by the duration of the agreed suspension periods. The extraordinary termination right remains unaffected. The rights of the patient/customer under this agreement are not transferable.

9. Fitness Training
The studio is partially unsupervised. However, the entrance, reception area, and training area are under video surveillance, and the activities are electronically recorded. The member acknowledges that they train at their own risk and responsibility during these times. The recordings are deleted after a certain period.

10. Special Circumstances
In the event of a closure of the facility due to force majeure, we reserve the right to decide whether and to what extent the contractual partner will be compensated.

11. Jurisdiction and Applicable Law
The place of jurisdiction for disputes arising from or in connection with this contract is the location of the company’s headquarters. The applicable law is exclusively Swiss law, excluding the conflict of laws provisions.

12. Final Provisions
Feel-Fit reserves the right to change these T&Cs at any time. The currently valid version is available on our website at www.feel-fit.ch/agb. The amended version comes into effect upon publication on the website.
Should any provisions of these T&Cs be invalid or unenforceable, the validity of the remaining provisions shall not be affected. Instead of the invalid points, the statutory regulation shall apply, if available.
